Alexandra has a sophisticated real estate and environmental practice and provides clients with transactional and litigation counsel on real estate, environmental, and regulatory matters, including acquisition, disposition, and redevelopment of contaminated sites, development of remedial action strategies, coordination with agencies and environmental consultants, resolution of cleanup liability disputes, permitting issues and regulatory compliance, and insurance recovery for environmental liabilities.
Alexandra also has extensive litigation and alternate dispute resolution experience with issues arising under CERCLA, MTCA, the Clean Water Act, and natural resource damage assessments. In addition to significant cost recovery and cost contribution experience, she offers seasoned counsel on the investigation and remediation of complex, multiparty sediment sites, including advising potentially liable parties and stakeholders on investigation strategies, agency coordination, allocation of past and future cost liabilities, and securing insurance coverage and navigating natural resource damage assessments under state and federal law.
Representative Matters
- Represents buyers and sellers in complex real estate transactions involving contaminated properties, including advising clients on identifying and allocating liabilities arising from environmental conditions.
- Manages complex environmental remediation projects, coordinates with environmental consultants to develop remedial action strategies, and advises clients on negotiating with governmental agencies and pursuing regulatory closure.
- Represents business and industrial clients working through regulatory permitting issues and advises on permit compliance concerns.
- Represents clients in negotiations with regulators on formal orders for cleanup sites and permit compliance issues.
- Represents clients in litigation and alternative dispute resolution in cost recovery and cost contribution actions arising under CERCLA and MTCA, including working through allocation processes at multi-party sites.
- Counsel clients on navigating natural resource damage assessments and represent litigants in natural resource damage disputes.
- Represents clients in Clean Water Act compliance issues, including assessing applicability of permit requirements to client operations.
- Represents landowners in real estate transactions for parcels adjacent to Superfund sites, including allocating liabilities, navigating historical insurance coverage issues, and determining future cost responsibility.
- Advises clients on managing risk and potential liability resulting from federal hazardous waste cleanup laws, including CERCLA, RCRA and MTCA.
- Represents property owners and developers with respect to potential liabilities resulting from natural resource damage assessments at hazardous waste sites, as well as negotiations with NOAA to minimize natural resource damage assessments.
- Advises clients regarding insurance coverage issues related to potential environmental liability.
