As of December 27, 2023, the life of certain Master Use Permits (MUPs) including design review approvals issued between September 2019 and December 31, 2026 are extended to six years. This is an increase from the previous maximum of three years, with the possibility of a two year extension through renewal and compliance with updated codes.
The new Ordinance 126979 eliminates the need for the prior renewal step at year 3, increases certainty in long-term vesting, and provides more flexibility for permit holders to navigate difficult conditions and bring essential housing and projects to fruition.
The key points of this ordinance are as follows:
- All MUPs issued since September 1, 2019, will now be automatically extended by SDCI to a maximum term of 6 years.
- All MUPs approved for issuance before the end of 2026 will be assigned a maximum term of 6 years, eliminating the need for a renewal and compliance with updated codes.
- However, it is important to note that variances, shoreline permits, temporary and intermittent uses, transitional encampments, and subdivisions are not covered by this extension.
This legislation aims to provide a boost to the local development community by preserving investments in land use entitlements and bridging the current market conditions.
