HCMP Client Alert: New Law Changes Condominium Construction Warranties in Washington

The ink is still drying on HB 1403, a new law that modifies the implied warranty and inspection provisions of the Washington Uniform Common Interest Ownership Act (WUCIOA). This new law creates new exemptions from the implied warranties of quality under RCW 64.90.675 for certain types of projects, including accessory dwelling units (ADUs) and buildings containing 12 or fewer units. In order to be exempted, declarants and dealers must provide an express warranty that meets certain requirements.

The new law, which will apply to condominiums created on or after July 27, 2025, also modifies the building enclosure design and inspection requirements under RCW 64.55 to expressly exclude ADUs that are organized as condominium units under WUCIOA.
