Creditor Rights, Reorganizations & Workouts

Intelligent, cost-effective approaches to helping clients overcome those inevitable bumps in the road.

HCMP has broad experience in a wide variety of debtor-creditor matters, both in bankruptcy and non-bankruptcy situations. We regularly advise public and privately held corporations (including a number of institutional lenders —see Lender Services), partnerships, and individuals with respect to collection, foreclosure, bankruptcy, loan workout, business restructuring, and other debtor-creditor matters.

Our work in this area includes representation of businesses, individuals, lenders, and borrowers in connection with:

  • Loan workouts and judicial and nonjudicial foreclosures-from routine nonjudicial residential foreclosures to complex commercial and construction workouts and receiverships
  • Business restructurings
  • Collection matters-from the initial demand stage through enforcement of judgment, including the establishment of procedures for handling recurring collection matters on a cost-effective basis
  • Representation of creditors, creditors' committees, trustees, post-petition lenders, and debtors in all types of bankruptcy cases and related adversary proceedings.
